General conditions of sale

Between the Company KS VISIONS,

represented by Mr. Jean-Pierre Krief as manager, duly authorized for the purposes of the following.

Thereafter the "seller" or the "Company", on the one hand, and the individual or legal entity proceeding to the purchase of products or services of the company, thereafter, "the Internet user", "the buyer", or "the customer" on the other hand.

It has been presented and agreed as follows:

PREAMBLE

The seller renders available to Internet users in France and abroad, on his website www.duplusloindelanuit.fr, works of art (photographs) known as vintage artist's proofs, which are freely offered for sale without limitation of number and available in different formats and different media, offered at a non-negotiable price inclusive of all taxes, excluding delivery charges.

The list and description of the goods offered by the Company can be viewed on the aforementioned site.

OBJECT

The following General Terms and Conditions of Sale (GTCS) determine the rights and obligations of the parties in the context of the online sale of products offered by the seller.

The general terms and conditions of sale may be modified, notably in case of any changes in legislation. The new general terms and conditions of sale will apply on the date of their publication on www.duplusloindelanuit.fr.
These terms and conditions can be viewed on the Company's website at the following address www.duplusloindelanuit.fr. The Company also ensures that their acceptance is clear and without reserve by putting in place a checkbox and a validation click. The customer declares that he/she has read all of these General Terms and Conditions of Sale, and, if applicable, the Special Terms and Conditions of Sale related to a product or service, and accepts them without restriction or reservation.

The present GTC are available in French and English. In case of any discrepancy between the two versions, the French version will prevail.

Article 1. Products

The essential characteristics of the goods and their respective prices are made available to the buyer on the company's websites. The customer certifies that he has received a detail of the shipping costs as well as the terms of payment, delivery and execution of the contract.

The seller commits to honoring the customer's order within the limits of available stocks of products only. In the absence of such availability, the seller shall inform the customer.

This contractual information is presented in detail and in French. According to French law, it is summarized and subject to confirmation during the validation of the order.
The parties agree that the illustrations or photos of the products offered for sale have no contractual value.

Except under special conditions, the rights granted hereby only benefit the natural person signing the order (or the person holding the provided email address).

Article 2. Prices

The prices appearing on the Site are indicated in Euros, including all taxes but excluding shipping costs. The Works ordered are invoiced at the price in force when the order is registered.

For orders placed outside of France: the Customer will be the importer of the Work in question. For the Works sent outside the European Union, taxes are likely to be eligible; these possible rights and taxes will be charged to the Customer and will be the Customer's entire responsibility, both in terms of declarations and payments to the authorities and competent bodies of the country or countries concerned.

Any change in the legal rate of the applicable VAT will be automatically reflected in the prices of the Works, as soon as it comes into force.

Only payments in euros are accepted.

The applicable prices are the prices displayed on the Site at the time of the order.

Article 3. Payment

The payment is due immediately with the order.
The customer can carry out the payment by credit card or bank check to the order of KS VISIONS to be sent to the following address KS Visions, 5, rue du Dahomey 75011 Paris.

The cards issued by banks domiciled outside of France must be international bank cards (Mastercard or Visa). The secure online payment by credit card is conducted by our payment provider Stripe. The transmitted information is encrypted in accordance with the rules of the art and meets the standards of online purchase and in particular the SSL (Secure Socket Layer) technology. Once the payment is initiated by the customer, the transaction is immediately debited after verification of the information. In accordance with the provisions of the Monetary and Financial Code, the commitment to pay by card is irrevocable. By communicating their banking information at the time of the sale, the customer authorizes the salesman to debit their card at the amount related to the indicated price. The customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or of the impossibility to debit the card, the Sale is immediately cancelled by right and the so is the order.

Article 4. Proof

The data recorded by the site constitute the proof of the whole of the transactions passed between KS Visions and its customers.
The data recorded by the payment system Stripe constitute the proof of the financial transactions.

Article 5. Reserve of property

All the works sold on the site www.duplusloindelanuit.fr remain the whole property of KS Visions until the complete collection of the selling price paid by the Customer to KS Visions.

Article 6. Order

- Availability

Our product offers are proposed within the limits of available stocks. Errors may exceptionally exist, especially in the case of simultaneous orders of the same product by several customers. In the case of unavailability of a product after placing your order, we undertake to inform you by email or telephone as soon as possible, and if necessary, the customer may then request a refund for the amount of the article. When a product is no longer available, it is displayed as "Unavailable print" and it is therefore no longer possible to order it. However, if you would like information about the availability of an article, you can contact us. KS Visions is not responsible for any stock shortage or unavailability of products.

- Finalization

At any moment, you can:
Make your selection of items by clicking on "Add to Cart" and then click on "Checkout Add products by clicking on "Continue shopping”
Consult the selected products by clicking on "Shopping Cart".

You can update the quantities by clicking on the number of units selected or delete an item by clicking on the cross.
For each product selected on the duplusloindelanuit.fr website, a summary page will be displayed, showing the photo of the item, its size, the quantity selected, its unit price and the total price of your order. We invite you to check the accuracy of your selection before confirming your order.

All Internet orders require that you provide accurate and complete information at the time of ordering. The information requested will include: title, last name, first name, telephone number, email address, billing address and delivery address. In order to complete the order correctly, and in accordance with Article 1316-1 of the Civil Code, the Customer commits to providing truthful identification.

Once completed, your order is transmitted directly to be processed.
You will be able to modify or cancel it only by contacting us by telephone or email.

KS Visions reserves the right not to accept an order from a customer with whom there is a dispute over a previous order, or if KS Visions reasonably believes that a customer has violated these Terms and Conditions, or for any other legitimate reason.
A summary of your order will be sent to you by email. The acknowledgement of receipt will show the title of the ordered products, the quantity, the price as well as the amount of the carriage costs.

Article 7. Terms of delivery

The products will be delivered to the delivery address indicated during the ordering process. We do our best to ensure that delivery takes place within less than 21 days. In case of difficulties, we commit to keeping you informed.

KS Visions uses for the shipments in France, sending service “recommandé” with A.R. of La Poste under reinforced envelope (implying handing-over to the recipient in exchange for an acknowledgment receipt).
For the shipments to the EU and the rest of the world, KS Visions also uses the registered sending service with A.R. of La Poste under reinforced envelope.

The delivery costs are calculated automatically as soon as you validate your delivery address and appear in the total to pay. The amount depends on the products in your order and the delivery zone.

When the package is sent, we will send you its corresponding number by e-mail.
Customs and other fees in the country of arrival are at the expense of the buyer.
In case of loss or damage of the product during transport, the customer must inform the carrier without delay.
You must check the conformity of the goods at the time of delivery and indicate the possible anomalies noted (open package, damaged product,..), if possible on the delivery note, in the form of handwritten reserves accompanied by your signature.

In case of unusual delay, an e-mail will be sent to you.

Article 8. Right of retractation

KS Visions is committed to supplying their customers with products corresponding to their related descriptive card. In spite of that, if you are not satisfied with the purchased product, KS Visions commits to exchanging or to refunding it. Shipments and returns will then be at your expense.

You have a seven-day legal deadline from the date of reception to return the products. In case of a credit card payment, the amounts collected will be refunded, excluding related charges. As these are art photographs, damaged or incomplete items will not be taken back and will be returned to you as it is, at your expense.

Unidentified returned packages can be sent back to the sender.
Products sold on sale or in promotion will not be exchanged or refunded.

Article 9. Litigation and recourse

The present contract is written in French and subject to French law. In case of legal dispute, only French courts will be competent.
